Welcome to Rental Paid! These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Rental Paid (“we,” “us,” or “our”). By accessing or using our platform, mobile application, or related services (collectively, the “Platform”), you agree to comply with these Terms. If you do not agree with these Terms, you may not access or use Rental Paid.
- Introduction
Rental Paid provides a cloud-based tenant and property management solution tailored for tenants, landlords, property managers, and public housing authorities (PHAs). Our services include, but are not limited to:
- Tenant screening and pre-approval tools.
- Rent collection and credit bureau reporting.
- Maintenance request tracking and third-party contractor integration.
- Section 8 payment management and compliance tools.
- Tenant and landlord rating systems.
- Mobile and web applications for streamlined access.
- Acceptance of Terms
By accessing or using the Platform, you affirm that you:
- Are at least 18 years old.
- Have the legal authority to enter into this agreement on behalf of yourself or any entity you represent.
- Agree to comply with all applicable laws, regulations, and these Terms.
For Businesses: If you are registering on behalf of a business or organization, you represent and warrant that you have the legal authority to bind that entity to these Terms. If you do not have such authority, you may not use the Platform on behalf of the entity.
- User Responsibilities
- Responsibilities of Tenants:
- Provide accurate, complete, and truthful information during tenant screening, rent reporting, and account setup processes.
- Use the tenant rating system ethically, ensuring reviews are based on genuine experiences.
- Promptly address disputes regarding rent payments, maintenance requests, or other matters.
- Responsibilities of Landlords and Property Managers:
- Comply with all local, state, and federal laws governing landlord-tenant relationships, including fair housing regulations.
- Use tenant data responsibly, ensuring compliance with privacy laws such as the General Data Protection Regulation (GDPR) or the California Consumer Privacy Act (CCPA).
- Ensure timely resolution of tenant concerns, including maintenance requests and disputes, as facilitated by the Platform.
- Cooperate with third-party contractors for services arranged through Rental Paid.
- Responsibilities of Public Housing Authorities (PHAs):
- Use Platform tools for accurate subsidy tracking, compliance monitoring, and reporting.
- Maintain transparency in communications and interactions facilitated through Rental Paid.
- Prohibited Activities:
Users are prohibited from:
- Misrepresenting or falsifying information during registration or use of the Platform.
- Using the Platform for unlawful, fraudulent, or unethical purposes.
- Attempting to tamper with, reverse-engineer, or interfere with the Platform’s functionality.
- Submitting defamatory, false, or otherwise unlawful content in ratings, reviews, or other public-facing sections of the Platform.
- Tenant Screening Process
Rental Paid offers a tenant screening service to assist landlords and property managers in making informed decisions about tenant suitability.
- Tenant Obligations:
- Required Information: Tenants must provide rental history, proof of income, employment details, and authorization for credit checks.
- Soft Credit Checks: Our screening process uses soft credit inquiries, which do not impact your credit score.
- Accuracy: You are responsible for ensuring the accuracy of information provided. Misrepresentation may result in denial of services or legal action.
- Landlord and Property Manager Obligations:
- Use tenant screening results solely for housing-related decisions in compliance with the Fair Credit Reporting Act (FCRA).
- Provide tenants with adverse action notices if a negative decision is based on screening results, as required by law.
- Screening Limitations:
Rental Paid does not guarantee the accuracy or completeness of third-party screening results. Users agree to hold Rental Paid harmless for disputes arising from inaccuracies or omissions in such reports.
- Subscriptions and Payment Terms
- Subscription Plans:
Rental Paid offers tiered subscription plans based on the number of properties managed or services utilized. Details are provided during account registration.
- Billing and Renewals:
- Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless canceled prior to the end of the billing cycle.
- Users are responsible for maintaining accurate and up-to-date payment information.
- Refunds:
Subscription fees are non-refundable unless otherwise specified in cases of billing errors caused by Rental Paid.
- Modifications to Plans:
- Users may upgrade their subscription at any time, with the new rate taking effect immediately.
- Downgrades take effect at the end of the current billing cycle.
- Data Privacy and Marketing Compliance
- Data Collection and Use:
Personal data is collected to facilitate tenant screening, rent reporting, and communication between tenants and landlords. Rental Paid does not sell personal data to third parties.
- Marketing Consent:
Users must provide explicit consent to receive marketing communications. You may withdraw consent at any time through account settings.
- Data Security:
Rental Paid employs industry-standard security measures to protect personal data. Users agree to hold Rental Paid harmless for breaches caused by factors outside its control.
- Transparency and Compliance:
Users can access, modify, or delete their personal data as permitted by applicable laws, such as GDPR or CCPA. Requests must be submitted through Rental Paid’s designated channels.
- Electronic Signatures
By using Rental Paid, you agree that electronic signatures submitted through the Platform are legally binding and equivalent to handwritten signatures under applicable laws, including the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
- Liability Limitations
- Third-Party Services:
Rental Paid integrates with third-party services (e.g., payment processors, credit bureaus, contractors). We are not liable for errors or disruptions caused by these providers.
- Ratings and Reviews:
Users are responsible for content submitted through the Platform. Rental Paid disclaims liability for defamatory, false, or unlawful reviews.
- Maintenance Requests:
Rental Paid facilitates, but does not guarantee, resolution of maintenance issues. Users must resolve disputes directly with contractors or landlords.
- Indemnification
Users agree to indemnify Rental Paid against any claims, damages, or expenses arising from:
- Violations of these Terms.
- Misuse of the Platform.
- Disputes between tenants, landlords, or third-party providers.
- Dispute Resolution
All disputes will be resolved through binding arbitration under AAA rules, with proceedings held in the state where Rental Paid is headquartered. Users waive the right to participate in class-action lawsuits.
